Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the https://smsbuyer.com website (the "Service") operated by SMSBuyer ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Definitions

  • "Service" refers to the SMSBuyer website (https://smsbuyer.com), including all its functions, features, and content related to providing temporary virtual phone numbers for receiving SMS messages for one-time password (OTP) verification.
  • "User", "You" means any individual, entity, or organization accessing, registering for, or using our Service.
  • "Account" means the account created by the User to access and use the Service.
  • "Virtual Number" means a phone number not associated with a physical SIM card, provided by us to the User for a specified duration for receiving SMS.
  • "OTP (One-Time Password)" means a password valid for only one login session or transaction, or a verification code sent via SMS.
  • "Credits" refers to the virtual value units purchased by the User and used within the Service to rent Virtual Numbers.
  • "Content" means information, text, graphics, images, or other materials appearing on the Service.

2. Service Description

SMSBuyer provides a platform where Users can rent temporary Virtual Numbers from various countries to receive SMS messages containing OTP verification codes. The Service is primarily intended to allow Users to register or verify accounts on various online platforms without disclosing their personal phone numbers.

The provided Virtual Numbers are temporary and intended solely for receiving SMS. They do not support outgoing calls, incoming calls, sending SMS, or MMS services.

3. Account Creation and Security

  • To access most functions of the Service, you must register and create an Account.
  • You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
  • You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • We reserve the right to suspend or terminate your Account if any information provided is inaccurate, not current, or incomplete, or if you violate these Terms.

4. Acceptable Use and Prohibitions

  • You agree to use the Service only for lawful purposes and in accordance with these Terms.
  • You agree not to use the Service:
    • In any way that violates any applicable national or international law or regulation.
    • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
    • To transmit, or procure the sending of, any unsolicited advertising or promotional material or "spam".
    • To impersonate or attempt to impersonate SMSBuyer, an SMSBuyer employee, another user, or any other person or entity.
    • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm SMSBuyer or users of the Service or expose them to liability.
    • To use Virtual Numbers for registering sensitive financial services, banking, or services directly related to financial transactions that could pose a security risk.
    • To repeatedly use Virtual Numbers for the same service after successfully receiving an OTP code.
    • In any manner that could disable, overburden, damage, or impair the server(s) or network(s) connected to the Service.
    • To attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
  • Using Virtual Numbers for illegal, fraudulent, or harmful activities is strictly prohibited. Violation of this policy will result in immediate account suspension without refund and potential reporting to relevant authorities.

5. Payments, Pricing, and Credits

  • Use of the Service requires the purchase of Credits. These Credits are used to pay for the rental of Virtual Numbers.
  • The price for renting Virtual Numbers may vary depending on the country of origin of the number and the service for which you need to receive an SMS. Current prices are displayed on our platform.
  • We accept payments through the following methods: Stripe (Credit/Debit Cards), PayPal, Cryptomus (Cryptocurrencies), NOWPayments (Cryptocurrencies), Payeer.
  • You agree to pay all fees incurred on your Account based on the pricing in effect at the time the fees were incurred.
  • All payments are final and non-refundable unless otherwise stated in our Refund Policy or required by law.
  • Purchased Credits do not expire as long as your Account remains active.
  • We reserve the right to change prices or payment methods at any time, with notice provided (where appropriate) via the website or direct communication.
  • You are responsible for all taxes associated with your purchase of Credits.

6. Refund Policy

  • Purchased Credits cannot be exchanged for cash or refunded under any circumstances.
  • Credits are deducted from your Account upon your request for a Virtual Number and successful allocation of the number by the system.
  • No Credit refunds will be issued for numbers that have successfully received an SMS, even if you do not use the OTP code or decide not to proceed with the third-party service.
  • In the event that you do not receive the expected SMS within the specified time frame (as indicated on the service page for that number), the system may (depending on the service and number status) automatically refund the Credits used for that number, or you may need to report the issue through our support system for review and consideration of a Credit refund.
  • The decision to issue a Credit refund in cases of non-receipt of SMS is at our sole discretion and may be based on system logs and other factors.
  • Abuse of the service or violation of these Terms voids any right to a Credit refund.

7. Intellectual Property

  • The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of SMSBuyer and its licensors. The Service is protected by copyright, trademark, and other laws of both Thailand and foreign countries.
  • Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SMSBuyer.

8. Limitation of Liability and Disclaimer of Warranties

  • The service is provided on an "AS IS" and "AS AVAILABLE" basis. SMSBuyer makes no warranties, expressed or implied, regarding the operation of the service or the information, content, or materials included therein. You expressly agree that your use of the service is at your sole risk.
  • SMSBuyer does not warrant that the service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
  • SMSBuyer does not guarantee the successful receipt of SMS messages or the validity of OTP codes received via the Virtual Numbers. Reliability depends on various factors, including the originating mobile carriers and the third-party services you are attempting to verify.
  • In no event shall SMSBuyer, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification

You agree to defend, indemnify, and hold harmless SMSBuyer and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

10. Termination

  • We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
  • If you wish to terminate your account, you may simply discontinue using the Service.
  • All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
